By accessing or using our services, you agree to comply with and be legally bound by the following Terms and Conditions. This Agreement constitutes a legally binding contract between you (\u201cthe Trader\u201d) and the Company. You have a duty to read this Agreement carefully before using the services. Continued use of the services shall constitute your acceptance of these terms, including any future amendments.<\/p>\n<p>The Company reserves the right to suspend, modify, amend, or terminate this Agreement at any time, at its sole discretion. Any updates to these Terms will be reflected by a revised Effective Date, and your continued use of the services following such updates constitutes your acceptance of the revised Agreement.<\/p>\n<p>PropFunders is not authorised or regulated by the Financial Conduct Authority (FCA) and does not offer any regulated financial products or services. All trading activity takes place in a simulated environment using virtual funds with no monetary value. Traders do not invest real funds, and the Company does not solicit, manage, or hold any customer deposits. The services are educational and performance-based in nature, and are not intended to constitute investment advice or an invitation to invest.<\/p>\n<p><strong style=\"font-size: 16px;\">1. Nature des services<\/strong><\/p>\n<p><strong>1.1. Evaluation Rules<\/h6>\n<p>3.1. Adherence to Trading Objectives: Traders must meet all trading objectives outlined in Section 2 to be eligible for progression to the next phase or to receive a funded account. Failing to meet these objectives within the allowed period or breaching risk parameters will result in disqualification.<\/p>\n<p>3.2. Violation Consequences: Breaching any of the following rules results in disqualification or termination of the account:<\/p>\n<p>Exceeding the Maximum Daily Loss or Maximum Loss<\/p>\n<p>Engaging in any activity described in Section 5 (Prohibited Trading Strategies)<\/p>\n<p>3.3. No Retake for Breaches: If a Trader violates any of the evaluation rules or trading objectives, the evaluation is considered failed. A new evaluation purchase is required to attempt again.<\/p>\n<p>3.4. Weekend Holding and News Events: Unless otherwise specified or through an add-on purchase, holding trades over weekends for the Instant Funding program is not permitted. Trading 3 minutes prior or 3 minutes after a major economic news events is not permitted. Doing so may result in a soft breach or account termination, depending on severity.<\/p>\n<p>3.5. Soft Breaches: Accumulating three or more soft breaches will result in termination, even if each individually does not disqualify the Trader. See Section 5 for details on what constitutes a soft breach.<\/p>\n<p>3.6. Minimum Trading Day Definition: A Minimum Trading Day is defined as a trading day during which a trader achieves a profit of at least 0.5% of their simulated account balance. Only days meeting this profit threshold will count toward the required minimum trading days for account progression or eligibility for payout.<\/p>\n<p><strong style=\"font-size: 16px;\">4. Capital Allocation and Scaling<\/strong><\/p>\n<p>The Company provides Traders with access to virtual capital for the purposes of simulated trading. The maximum initial capital allocation available to any Trader prior to scaling is $450,000 in virtual funds. Subject to performance and compliance with all trading rules and program requirements, Traders may be eligible for account scaling.<\/p>\n<p>Through the Company\u2019s Account Scaling Plan, the virtual capital allocation may be increased incrementally based on profitability and consistency. The total capital allocation available to a Trader under the scaling plan may reach up to USD$2,500,000, and in certain cases, may exceed this amount through the use of approved add-ons.<\/p>\n<p>Scaling decisions are made at the sole discretion of the Company and may take into account factors such as risk management, drawdown control, trading behavior, and adherence to all platform terms and conditions. The Trader acknowledges that all funds provided remain virtual and are intended solely for performance evaluation within a simulated environment.<\/p>\n<p><strong style=\"font-size: 16px;\">5. Strat\u00e9gies de trading interdites<\/strong><\/p>\n<p>Les strat\u00e9gies de trading suivantes entra\u00eeneront la r\u00e9siliation\u00a0:<\/p>\n<ul>\n<li><strong>Copy Trading:<\/strong>&nbsp;Allowed only from another PropFunders account, broker account, or prop firm account owned by the same individual. Copy trading from accounts not owned by the same individual is strictly prohibited.<\/li>\n<li><strong>Account Management Services:<\/strong>&nbsp;Not allowed. Trading must be based solely on the Trader\u2019s ability.<\/li>\n<li><strong>Specific Trading Strategies:<\/strong>&nbsp;High Frequency Trading (HFT), arbitrage trading, exploiting errors or latency in the pricing and\/or platform(s), one sided betting, \u2018pass your challenge\u2019 type services, using third party signals, group trading, tick trading\/tick scalping, hedging on two different PropFunders accounts in attempt to ensure one is profitable and similar strategies used to game the system.<\/li>\n<li><strong>Commerce EA\u00a0:<\/strong>&nbsp;Autoris\u00e9 dans les conditions suivantes :\n<ul>\n<li>Does not copy trades of other person\u2019s signals<\/li>\n<li>Does not perform tick scalping<\/li>\n<li>Does not engage in latency arbitrage trading<\/li>\n<li>Does not engage in reverse arbitrage trading<\/li>\n<li>Does not engage in hedge arbitrage trading<\/li>\n<li>Does not use emulators<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>In addition to the above, the use of Expert Advisors (EAs) is strictly prohibited in circumstances where the Trader does not have exclusive ownership of the EA\u2019s source code or where the EA is commercially available to the public, including but not limited to those that can be purchased online or acquired through similar distribution channels. The Company prohibits the use of any EA that may result in identical or substantially similar trading patterns across multiple traders\u2019 accounts, such as those arising from shared strategies or commonly available third-party EAs. This policy is intended to ensure that all trading activity remains individual and skill-based, and to prevent coordinated or replicated trading behavior that undermines the integrity of the simulated environment.<\/p>\n<ul>\n<li><strong>Coh\u00e9rence de l&#039;adresse IP\u00a0:<\/strong>&nbsp;The region of IP address(es) used to log into the Master account must remain consistent. Proof such as an airline ticket, passport stamp, or live video of the location may be requested. Multiple accounts on a similar IP address are strictly prohibited to rule out group trading and ensure fairness.<\/li>\n<li><strong>Soft Breach Policy:&nbsp;<\/strong>In addition to the circumstances outlined above, the Company reserves the right to terminate a Trader\u2019s account upon the accumulation of three (3) or more soft breaches, even if each breach individually does not constitute grounds for immediate termination. A soft breach refers to a minor violation of trading rules that, while not immediately disqualifying, indicates a pattern of non-compliance. Examples of soft breaches may include, but are not limited to, failing to close trades prior to news events or weekend holding violations where prohibited. Conformit\u00e9 aux lois et aux pratiques AML<\/strong><\/p>\n<p>The Company may restrict certain jurisdictions to comply with local laws and anti-money laundering (AML) practices. The Trader agrees to provide all necessary documentation to satisfy the Company\u2019s KYC and AML requirements.<\/p>\n<p><strong style=\"font-size: 16px;\">7. Limitation de responsabilit\u00e9<\/strong><\/p>\n<ul>\n<li>The Company shall not be liable for any losses incurred by the Trader. The Trader acknowledges that trading in financial markets involves significant risk and that they are responsible for any losses incurred while trading.<\/li>\n<li>At all times, the funds provided by the Company are virtual, except for trader payouts which are real. The Trader understands and agrees that any profits earned in the simulation accounts are virtual until actual payouts are made by the Company.<\/li>\n<li>The Trader acknowledges and agrees that all trading activities occur in a simulated environment subject to technical limitations. The Company shall not be held liable for any issues arising from platform performance, including but not limited to slippage, latency, execution delays, price discrepancies, system outages, internet disconnections, or any other technical malfunction or error. The Trader accepts that such issues may affect trading results and that the simulated environment may not perfectly replicate live market conditions. The Company disclaims all responsibility for losses, missed opportunities, or discrepancies resulting from such circumstances.<\/li>\n<\/ul>\n<p><strong style=\"font-size: 16px;\">8. Confidentialit\u00e9<\/strong><\/p>\n<p>Les deux parties conviennent de garder tous les termes du pr\u00e9sent accord confidentiels et de ne divulguer aucune information concernant les strat\u00e9gies de trading, les d\u00e9tails du compte ou toute autre information exclusive \u00e0 des tiers sans consentement \u00e9crit pr\u00e9alable.<\/p>\n<p><strong style=\"font-size: 16px;\">9. Modifications<\/strong><\/p>\n<p>Le pr\u00e9sent accord constitue l\u2019int\u00e9gralit\u00e9 de l\u2019accord entre les parties et remplace toutes les discussions, accords ou ententes ant\u00e9rieurs de quelque nature que ce soit. Tout amendement ou modification du pr\u00e9sent accord doit \u00eatre fait par \u00e9crit et sign\u00e9 par les deux parties.<\/p>\n<p><strong style=\"font-size: 16px;\">10. Loi applicable et juridiction<\/strong><\/p>\n<p>Le pr\u00e9sent accord sera r\u00e9gi et interpr\u00e9t\u00e9 conform\u00e9ment aux lois du Royaume-Uni. Tout litige d\u00e9coulant de ou en relation avec le pr\u00e9sent Accord sera r\u00e9solu par une m\u00e9diation bas\u00e9e au Royaume-Uni avant qu&#039;une action en justice ou une proc\u00e9dure judiciaire puisse \u00eatre engag\u00e9e.<\/p>\n<p><strong style=\"font-size: 16px;\">11. Indemnisation<\/strong><\/p>\n<p>The Trader agrees to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses arising out of or in any way connected with the Trader\u2019s trading activities or breach of this Agreement.<\/p>\n<p><strong style=\"font-size: 16px;\">12. Account Termination<\/strong><\/p>\n<p>The Company reserves the right to terminate the Trader\u2019s account under the following circumstances:<\/p>\n<ul>\n<li>Failure to fulfill KYC requirements.<\/li>\n<li>Use of prohibited trading strategies, outlined in clause 5 (Prohibited Trading Strategies).<\/li>\n<li>If the Company detects that your trading constitutes Prohibited Trading, your participation in the program will be terminated and may include forfeiture of any fees paid to the Company. Additionally, and before any Trader shall receive a funded account, the trading activity of the Trader under these Terms and Conditions shall be reviewed by both the Company and the Broker to determine whether such trading activity constitutes Prohibited Trading. In the case of Prohibited Trading, the Trader shall not receive a funded account.<\/li>\n<\/ul>\n<p>Additionally, the Company reserves the right to disallow or block any Trader from participating in the program for any reason, in the Company\u2019s sole and absolute discretion.<\/p>\n<p><strong style=\"font-size: 16px;\">13. Severability<\/strong><\/p>\n<p>Si une disposition du pr\u00e9sent accord est jug\u00e9e invalide ou inapplicable par un tribunal comp\u00e9tent, cette disposition sera supprim\u00e9e du reste du pr\u00e9sent accord, qui restera par ailleurs pleinement en vigueur.<\/p>\n<p><strong style=\"font-size: 16px;\">14. Notices<\/strong><\/p>\n<p>Tous les avis ou autres communications requis ou autoris\u00e9s en vertu du pr\u00e9sent Contrat doivent \u00eatre faits par \u00e9crit et seront r\u00e9put\u00e9s avoir \u00e9t\u00e9 d\u00fbment donn\u00e9s lorsqu&#039;ils sont remis en main propre ou envoy\u00e9s par courrier recommand\u00e9, avec accus\u00e9 de r\u00e9ception demand\u00e9, ou par courrier \u00e9lectronique aux adresses sp\u00e9cifi\u00e9es par les parties.<\/p>\n<p><strong style=\"font-size: 16px;\">16. Responsibility to Stay Updated<\/strong><\/p>\n<p>The Company reserves the right to change its terms and conditions and rules by posting updates on its website. It is the Trader\u2019s responsibility to check the website for any changes or updates to the terms.<\/p>\n<p><strong style=\"font-size: 16px;\">17. Payments and Fees<\/strong><\/p>\n<p>All payments are final and for virtual evaluation purposes only. In order for a Trader to receive any Virtual Performance Fee, sufficient profits must be generated within the simulated trading environment. Alternatively, the Company may, at its sole discretion, fund such Virtual Performance Fee from its own resources. For the avoidance of doubt, you will never be provided with access to the live market through your use of the Services.<\/p>\n<p>Vous aurez la possibilit\u00e9 d&#039;effectuer des retraits toutes les deux semaines.
